Vampires are humans too! Okay, maybe not. But they do like a beer once in a while.
TI Beverage Group, a.k.a. Vampire Brands, a Los Angeles based winery, produces beer and vodka with vampire-themed names, such as: Chateau du Vampire, Vampyre, Dracula, and Dracula’s Blood. Their products are sold through websites that also have “vampire” as part of the domain name.
Mercury Brewing and Distribution Co., based in Massachusetts has a similar product: Vampire Slayer beer.
Vampire Brands claim this infringes their “Vampire Pale Ale”; the relevant public (blood-thirsty beer drinkers?) could confuse the two or will assume it is a spin-off.
It seems Vampire Brands has a good case: similar brands, similar products. Their IP attorney can put his teeth in this one.
