It was already known that the EUIPO is rather protective in terms of morality, when it comes to trademarks that consist of vulgar words. Trademarks with FUCK are refused because they are regarded contrary to public policy. We can understand this, although EUIPO should keep in mind that it is not the defender of our morality.
But EUIPO takes a step further by also refusing recent trademark applications such as F *** WHO DO NOT LIKE THIS PLACE and ENJOY YOUR F ****** DINNER. Moreover, in line with the MAFIA decision, the trademark ESPRESSO MAFIA was rejected. One could argue about these marks.
But now the EUIPO takes a remarkable decision: the trademark PIK-A-POO for scoops to pick up pet waste has been rejected. Since when is dog poo offensive?
