Larry Flynt, publisher of Hustler, has started a lawsuit against his own brother, Jimmy Flynt. Why? Well, it is all about trademark infringement: the use of the name Flynt on a shop for (of course) erotic products. The full name of the shop is Jimmy Flynt Sexy Gifts-Naple. The trademark Flynt is belonging to Flynt, Larry Flynt. In the observations Larry Flynts stresses that he already has won two lawsuits and that his brother is not allowed to use Jimmy Flynt Sexy Gift.
As all IP practitioners know, even you are using your own name in a trademark / company name, this will not say that you cannot infringe other trademark or company rights. In case of the Flynts, the family relationship makes it a painful situation. Larry Flynt will probably skip the family barbeque this summer.
