Greatest Show on Earth

Artist Kid Rock is being sued for using the slogan “Greatest Show on Earth” for his upcoming tour. Confusing or just misleading?

Feld Entertainment, which apparently owns the trademark to the tagline, recently filed a lawsuit against the singer.

The company owns the Ringling Bros. and Barnum & Bailey Circus. Although in May 2017, the circus’s tours had ended, Feld retained all of its intellectual property. The phrase “Greatest Show on Earth” has long been trademarked.

Feld Entertainment states that Kid Rock did not obtain its permission to use the phrase for his “Greatest Show on Earth” tour that is scheduled to begin in 2018.

It is arguable whether a slogan like “Greatest Show on Earth” can even be a trademark. Is it not too generic? Is it even perceived as a trademark? A US court will have to decide. Unless Kid Rock changes the name, or pays a royalty for using it.
