Anyone can organize a running event. But a Color Run? That’s a whole different (trademark) story…
Running-event company The Color Run, LLC filed a law suit against rival company My School Color Run, LLC for willful trademark infringement and unfair competition.
The Color Run, founded in 2011, is now the largest running series in the world, and has been experienced by over 6 million runners worldwide in over 35 countries. With only two rules, the idea is easy to follow:
- Wear white at the starting line!
- Finish plastered in colour!
My School Color Run is organising a similar event: running for charity – ‘FUNdraising” as they call it – while being blasted with colourful powder.
But The Color Run is not amused and states that My School Color Run uses similar “color”-marks that allow it to benefit from Color Run’s established brand, and are likely to cause confusion amongst consumers as to the origin or association of the company with Color Run.
It remains to be seen who will end up the winner here. Trademark cases are rarely black and white issues.
