chanel logoA Dutch nail salon is forbidden to use its name Chanelle by fashion brand Chanel. “But it is my own name!”, the owner says.

In the city of Papendrecht, The Netherlands, a new nailbar opened. The owner, Le Ngyun, has immediately been faced with the ‘dangers’ of being an entrepreneur. Not long after opening her shop, she got a cease and desist letter from Chanel’s lawyers.

The French fashion house claims that the nailbar is infringing its trademark rights, and unfairly piggybacked on the success of the Chanel brand.

Owner Ngyun is astonished: “Chanelle is a blend of the name of my daughter, ‘Chanel’, and my own name, ‘Le’; hence ‘Chanelle Nailbar’. “The worst part is that I can not keep my names. That’s just frustrating.”

The question remains whether ‘Chanelle’ is confusingly similar to ‘Chanel’, with regard to the services of a nail bar. But another one’s trademark registration can indeed prevent you from using your own name.
