No copycat

pumaPuma is a famous brand. The same applies to the logo, a jumping puma. Can Puma  act against every logo of a feline? Despite of the worldwide reputation of the logo,  the answer is not necessarily a yes. Much depends on the similarity between the marks, between products and services, the relevant circumstances of the case, etc.

In a recent opposition proceedings things went wrong for Puma. The opposition was directed against the above logo. This trademark was filed for machinery for processing wood and PVC. And although the European Trademark Office considers that there is a similarity between the two predators, the OHIM thinks that the products are not related at all. The distance between the products is so big that the required link by the relevant public between the trademarks can never be satisfied.
