Perhaps the most famous weapon in the world, the Kalashnikov (left a more artistic version of the rifle). This weapon was made by Mikhail Timofeyevich Kalashnikov. World famous, but for brands this fame is not always that favorable.
Like in this case: a recent application KALASHNIKOV for weapons by the Kalashnikov concern has been rejected by the OHIM. According to the trademark office this trademark cannot function any more as an indication of origin. There are worldwide several manufacturers that are producing this weapon, without a license or supervision of the Kalashnikov concern. So, KALASHNIKOV has become a descriptive term for weapons and related products, even though there is a relationship between the trademark KALASHNIKOV and the applicant. The OHIM referred also to the decision of the Court of Justice on the trademark AK 47, which had the same outcome.
A powerful weapon that cannot defend itself.
