The swoosh of Nike is probably one of the most iconic logos in the world. The question is whether an application of this logo, without its fame, would be accepted in the EU. A very similar logo (left) filed for clothing was rejected twice, the second time in appeal.
According to the OHIM, this logo is too basic. The fact that this logo is representing the head of a Tibetan antelope (we have to admit, the argument is original) does not alter this opinion as this does not influence the distinctive character of the logo itself. This decision shows us that the OHIM is not very keen on abstract and basic logos, recently.
