Burberry, one of the famous fashion marks in the world, is known for its trench coats. In order to demonstrate the influence of Burberry in a timeline, it used a photo of Humphrey Bogart wearing a trench coat in the last scene of the movie Casablanca.
This was very much against the will of the heirs. They contacted Burberry and asked, according to Burberry, a considerable amount for the use of the photo. In order to have a declaration that they are not infringing any rights Burberry filed a lawsuit in New York. The heirs reacted with a lawsuit in LA.
According to Burberry the defendant is attempting to exert and assert against Burberry rights which it does not possess. Moreover, the timeline is protected under the First Amendment to the U.S. Constitution. The picture was not used to sell merchandise.
