The International registration procedure is a convenient and cost efficient way to register your trademark.
A. International registration
India is the newest member of the Madrid System for the International registration. As of July 8, 2013 it will possible to file an International registration for India.
Recently New-Zealand, Mexico and Colombia already joined the Madrid System, bringing the total to 90 countries.
With the addition of these countries – and possible new countries in the near future – it will be more and more attractive to protect a trademark in several countries using the International registration system.
Beware: in many member states of the Madrid System, the national trademarks office will examine the trademark application. Sometimes this means a refusal in case a similar older trademark exists. We therefore always recommend a prior trademark availability search.
Knijff has developed Multisearch®: a convenient service to clear trademarks in India or anywhere else in the world. You will receive a clear answer on the question whether or not your trademark is available. If you wish to receive more information about Multisearch, please contact us.
B. Croatia joins the EU As of July 1, 2013 Croatia has joined the European Union.
When you are the owner of an European trademark registration, your mark will automatically be protected in Croatia as of July 1, 2013. A European registration will then include 28 countries.
Please note that it will not be possible for owners of older national marks in Croatia to object the automatic extension of the European registrations for Croatia. When there is a trademark conflict between an older Croatian trademark and an European registration, the use of this European registration for Croatia could however be restricted.
