Trademark eclipse

sol kitchenNewport Beach’s SOL Cocina is suing Denver juice bar SOL Kitchen over trademark infringement.
SOL Cocina states to have tried to solve the issue amicably, but reaching out to the juice bar’s owners before they opened to discuss possible ‘confusion in the marketplace’ over the names, did not end positively.
The restaurant SOL Cocina, known for its elegant Mexican cuisine and top-shelf cocktails first opened in Newport Beach in 2009. The restaurant chain is now planning to open a restaurant in late July in the Denver area. And that’s where SOL Kitchen is!
SOL Cocina states that the owners of the Denver juice bar have asked how much money SOL Cocina was willing to pay them to change their name. This eventually led to the lawsuit.
“Please know that our goal is obviously not to challenge every SOL restaurant but rather protect ourselves in the immediate markets that we are opening restaurants”, a spokesperson for SOL Cocina said.
We are curious to see for which of the two SOLs this trademark case will lead to an eclipse.
