The brewer for the famous Kwak-beer, Bosteels from the East-Flanders Buggenhout, accused Brasserie D’Ebly from Léglise at Neufchateau, for infringing their trademark. The Kwak logo depicts the typical “Kwak-glass” in wooden holder.
The Antwerp court did not agree: the beer glass of “La Corne du Bois des Pendus” shows no similarities with the beer glass of Kwak.
The glass of La Corne du Bois Pendus does also hang in a wooden holder, but there are no real similarities and there is no likelihood of confusion, the court ruled. The glass of La Corne’s horn-shaped, that of Kwak’s is sphere-shaped.
Furthermore, the court held, that Kwak’s brewer should refrain from further commenting negatively on its competitor.
