Did you hear about the one where the trademark attorney takes a bratwurst to court? Well, it happened in Wisconsin.
Milwaukee based company Klement Sausage is suing competitor Sheboygan’s Johnsville Sausage for infringing its trademark slogan.
Klement claims it successfully registered the trademark “Backyard Bratwurst” back in 2009 for ‘bratwurst’, and that Johnsville was denied a trademark for “Backyard Grill Brat”.
“Despite this independent government assessment and despite Klement’s demand to stop its infringing conduct, Johnsonville refuses to remove its confusingly similar trademark from the market, which it is using to sell identical goods: bratwurst sausages”, says Klement.
Quite the headline: Sausage seller sues similar sausage seller’s slogan (try saying that five times in a row without tripping over your tongue). This case will definitely be continued. We will keep you posted.
